I AGREE! The punishment is not for drinking, it is for driving in an impaired state. Anything that a driver does causing their driving to be impaired should have the same penalty.

The only way I see that the penalty should be less for a distracted driver vs a drunk driver would be if someone could find a way to lessen the damage/injury to the victim hit by a distracted vs a drunk driver!

Plus, now don't get me wrong here and blast me because I am NOT defending drunk drivers. When people get behind the wheel after drinking there judgement is impaired - that's why we don't want them behind the wheel. But seeing there judgement is impaired they do not even realize they shouldn't be driving (that's why you should make plans BEFORE you start drinking). Now the person who decides to text while driving does so in a sober state of mind making conscious a decision to ignore the road and their surroundings to send that oh so important text!  less

    • Geezer7 Texting must be out while in motion. I think if caught the penalty should be stiff. As for talking I think a hands-free should be a must. Those thing are too cheap and too easy not to use them.

Once you kill or injure someone it is too late.

Should we increase the penalty ?? Some people are going to do it no matter the fines or penalties, tho I would advocate giving the officer some discretion in writing out a higher rated ticket, then just breaking the speed limit sort of ticket. equal to a wet reckless offense, yet w/out solid figures I cant make any call on increasing it to the DUI status.
Drunk is a whole another ball game,as most of us who ever drove toasted know, especially the sort of damage one can do. The texter most likely would stop n not run, while a drunk typically will leave the scene of the accident if possible..  less

If you are hit, the first words from your mouth should be SB 1967! This bill was passed to gain public Safety Awareness for cagers to be aware of riders. We are finding out that many law enforcement officers are not aware of the bill and end up giving the killer only a citation for "Failure to Yield"! See following:

A542.4045.AAPENALTIES FOR FAILURE TO YIELD RIGHT-OF-WAY
OFFENSE RESULTING IN ACCIDENT. If it is shown on the trial of an
offense under this subtitle in which an element is the failure by
the operator of a vehicle to yield the right-of-way to another
vehicle that an accident resulted from the operator ’s failure to
      yield the right-of-way:
(1)AAthe offense is punishable by a fine of not less
than $500 or more than $2,000, if a person other than the operator
of the vehicle suffered bodily injury, as defined by Section 1.07,

Even with this laws on the book there is still texting and driving. What worst is now they lower the device so it in there lap so no one sees them. Which inters forces them to lower there head so there is no eye contact at all with the road. I'm beginning to think I would be better off with drunk drivers on the road then texters. I don't condone drunk drive so don't get me wrong.

  • Hawk6351 Sadly, I must report… for anyone who may know (i understand most of the original fish members who knew him have probably moved on maybe…) But my dad RevZeke, and the Alpha Omegas club president, passed away October 31st. I had the longest ride of my life, from NE Ohio to SW Missouri to be there for my mom…. It didn’t help that my trusty Harley chose to do Harley things on that ride… none the less… got done what was needed. I know that 10-12 years back he had friends here. Thought y’all should know. The Club board chose to have me take his place; I can’t fill his shoes but I’m gonna try to follow his footsteps. Love and respect! See you all in the wind!

I like taking it nice and slow when I'm just riding but when I have somewhere to be I tend to do 5-10 over and take as many short cuts as I can this has gotten me in trouble a couple of times. The route has taken me down to dirt not friendly and you have to ride slow. This is usually when I see the wildlife.
